Please read carefully. This describes the terms and conditions under which ContactContractors.com offers the services provided through our web site.
By accepting these terms, you confirm that you are 18 years of age or older, are capable of entering into a binding agreement, and that you will accurately complete any subscriber information submitted to us.
We offer this web site, depending on your acceptance without change, of the following
Terms and Conditions, as well as any other declarations written in this agreement (the “Terms & Conditions”). By your use of this website, you agree to all such Terms and Conditions, and declarations in effect at this time. Revision of our Terms & Conditions may occur at any time: modifications will be edited and incorporated into our Terms & Conditions for public view. Our Terms & Conditions were last revised 01/09/08.
In using ContactContractors’ services, you acknowledge that ContactContractors is not acting as your general contractor, agent, or advisor. You may want to consult with appropriate expert advisors to assist in your home improvements, including but not limited to: a lawyer regarding contracts, permits, and other necessary job documentations, and an insurance professional regarding the contractor's and your own insurance coverage requirements. ContactContractors.com does not recommend or endorse any specific service provider, provide advice on which service provider to select, or screen any individual service provider's personal credit or legal standing. Therefore, it is your sole responsibility to select a service provider and to negotiate the terms specific to your service contract agreement for any work performed.
ACCESS TO CONTACTCONTRACTORS. After registration, you may choose your own password to access the ContactContractors services through the ContactContractors Web site. In some cases, this may be your current zipcode. Some areas of the ContactContractors site are available without registering for our services: however, THESE TERMS AND CONDITIONS ARE STILL VALID, AND WILL APPLY FOR UNREGISTERED USERS.
SERVICES TO HOMEOWNERS. At ContactContractors, we are dedicated to helping you find the service professionals and services you are looking for. After entering your information and service requests, we will provide a list of service professionals in or near your neighborhood who may be interested in completing the work. This applies to users who either ‘Post a Job’ or ‘Schedule a Service Call.’
However, we do not guarantee that we will be able to match your service needs with a service professional or that there are service professionals or workers in your area that either are capable or willing to complete your service needs. Although we take certain steps to examine the credentials of our listed service professionals and workers, we make no guarantees or representations regarding the skills or representations of such service professional or the quality of the job that he or she may perform for you if you elect to retain their services. ContactContractors does not endorse or recommend the services of any particular service professional or worker. It is entirely up to you to enter into a direct contract or otherwise reach agreement with a service professional, and we do not guarantee or warrant their performance on the job or the outcome or quality of the services performed. The service professionals are not employees or agents of ContactContractors nor is ContactContractors an agent of the service professionals and workers.
Homeowners may choose to hire a worker for a job. Any service professional found through our Workers Profiles may not be licensed or insured. ContactContractors provides this service as a cost-saving measure and homeowner hereby indemnifies ContactContractors for all work completed by a Worker found through ContactContractors services. ContactContractors does not perform, and is not responsible for, any of the services requested by you in your service request or job postings. Your rights under contracts you enter into with service professionals and or workers are governed by the terms of such contracts and by applicable federal, state, provincial and local laws. Should you have a dispute with any service professional, you must address such dispute with the service professional directly, AND YOU HEREBY AGREE TO RELEASE CONTACTCONTRACTORS (AND OUR OFFICERS, DIRECTORS, AFFILIATES, EMPLOYEES AND AGENTS) AND ANY OTHER PERSON, FIRM, OR ENTITY (INCLUDING OUR BUSINESS PARTNERS SUCH AS A PRODUCT MANUFACTURER OR SUPPLIER WHO MAY EMPLOY THE CONTACTCONTRACTORS MATCHING UTILITY) FROM ANY DAMAGES OR CLAIMS (INCLUDING CONSEQUENTIAL AND INCIDENTAL DAMAGES) OF EVERY KIND OR NATURE, SUSPECTED AND UNSUSPECTED, KNOWN AND UNKNOWN, AND DISCLOSED OR UNDISCLOSED, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES AND YOUR DEALINGS WITH SERVICE PROFESSIONALS OR WORKERS.
AGREEMENT WITH CONTRACTORS & WORKERS. A Service Provider (Contractor and or Worker) who has submitted company information to ContactContractors with the intent of being listed acknowledges, accepts, and agrees to be bound by the Terms and Conditions. Service Providers must adhere to a strict code of conduct to retain their ContactContractors membership. All advertising and sales literature shall be truthful and accurate. No misleading statements or claims shall be made. All contracts shall be free of ambiguities or omissions that may obscure or confuse either party's obligations. All customer complaints will be handled in a fair, reasonable and prompt manner. Service Providers agree to honor their obligations and commitments to customers. Service Providers ensure that the testimonials and photos displayed on ContactContractors are legitimate, and that testimonials are written by customers, and not written with the intent of misleading the public.
Service Provider will carry comprehensive general liability insurance with the required amount for the particular trade, as set by state law. Service Provider will provide ContactContractors a certificate of insurance with policy number and insurance carrier. Service Providers must provide Workers' Compensation Insurance where required by law. Service Providers must provide proof of current licenses for all jurisdictions and trades, where required, for services it intends to perform. In the event that a Worker is hired by a homeowner to provide a service, the Worker must not misrepresent their work as being completed by a licensed and insured contractor. Subcontractors used to perform work as agents for the Service Provider must meet insurance requirements as if they are a service provider or the service provider must provide coverage under their policies. ContactContractors requires that Service Providers maintain a high standard of honesty, integrity, and responsibility in their dealings with customers.
Upon executing an agreement with a customer, Service Provider is responsible for all terms and conditions outlined in the terms of the contract based on State requirements for content. Service Providers shall perform all jobs as an independent contractor and not as an agent, employee, or representative of ContactContractors. ContactContractors may terminate this agreement for any reason with notice. Notice of termination must be issued in written form. Service Providers shall take all necessary precautions to prevent injury or property damage to any customer or other person while performing its obligations as a Service Provider. Service Providers shall indemnify and hold harmless ContactContractors and its officers, agents directors, and employees against any claim, loss, judgment, expense and injury to person or property resulting directly or indirectly, in whole or part, for any act, omission, or negligence on the part of the Service Provider or any subcontractors employed by Service Provider, in the performance or failure to perform the scope of work covered by these Terms and Conditions. Contractors may hire Workers through ContactContractors’ services. ContactContractors will not be held liable for any misrepresentation that is made on the Workers Profile page and is hereby indemnified of any claim, loss, judgment, expense and injury to person or property resulting directly or indirectly, in whole or part, for any act, omission, or negligence on the part of the worker.
BILLING AND PAYMENT POLICY. Contractors are obligated to pay for the service of the ContactContractors.com website, unless specifically notified otherwise. Contractors pay a $40.00 monthly subscription, which has a subscription term of 30 days and is automatically renewed every month thereafter. The monthly rate applicable at the time of original registration will apply for each month the ContactContractors.com services are used thereafter. This price structure may change in the future, but Contractors lock into the term and price of the subscription they choose upon registration.
Homeowner use is free of charge with exceptions mentioned here. Homeowners are obligated to pay a Onetime fee of $25.00 for every Emergency Service Call that is initiated; this rate is good for the duration of One Emergency Service request until its completion. However, this $25.00 fee is not complete payment for the work that is to be provided. It is a dispatch charge and should not be confused with full or partial payment to the dispatched Service Professional. Homeowners are solely responsible for negotiating all terms and agreements, including payments, with Contractors and or Workers dispatched for the Emergency Service Call and the completion of the Service request. Homeowners are obligated to pay $20.00 for access to the ContactContractors.com Worker Profiles, which has a subscription term of 90 days. This payment will not be automatically renewed and does not represent full or partial payment to Worker for work requested. Homeowners are responsible for negotiating all terms and agreements, including payments, with Workers listed on the Worker Profile. All rates may be altered by any promotion selected at the time of registration.
For all fees, ContactContractors.com will charge the User’s credit card or debit card according to the agreed-upon fee between User and ContactContractors.com for use of the services of the Site.
While ContactContractors.com will use its best efforts to ensure the privacy of all credit card, debit card, and other personal information, we expressly disclaim any liability for any damage that may result should any information be released to any third parties. User does hereby agree to hold ContactContractors.com harmless for any damages that may result therefrom. ContactContractors.com will use a third party service to process your credit card information. For further information regarding that service, please contact ContactContractors.com to request information about ContactContractors.com credit card processing company. Renewal of Contractor subscriptions will be automatically extended for successive renewal periods of the same duration as the subscription term originally selected at the prior term’s subscription rate. ContactContractors.com will continue to renew subscriptions until the Contractor requests a Cancellation. If a Contractor cancels the subscription, the Contractor will have access to subscription benefits until the end of the then-current subscription term; the subscription will not be renewed after that term expires. However, Contractors will not be eligible for a prorated refund of any portion of the subscription fees paid for the then-current subscription period.
REVIEWS & RATINGS. Homeowners are encouraged to submit written reviews and ratings of a Contractor or Worker’sperformance, whether they are in the ContactContractors directory or not. ContactContractors does not verify the authenticity of each review before publishing it to the site but does collect contact information from submitters in an attempt to reduce fraudulent reviews. Homeowners should be careful to only post accurate statements about their experience with their Service Provider, as slander laws are designed to protect people/companies from testimonial misuse. Contractors receive a copy of each review we receive, and have the right to add their own comments to any review posted about them. ContactContractors will not edit reviews in any way other than to correct spelling mistakes and blatant grammatical errors. ContactContractors has the discretion to remove reviews that include foul or vulgar language. Notwithstanding, ContactContractors reserves the right to add, change or remove reviews at any time. ContactContractors is not responsible for the contents of reviews posted to any Contractor's profile. ContactContractors will not be held liable for any bad, negative, discouraging, or slanderous reviews posted by Homeowners or Users of the ContactContractor website, and is hereby indemnified of any claim, loss, judgment, expense and injury to person or property resulting directly or indirectly, in whole or part, for any act, omission, or negligence by the Homeowner or User.
DISPUTE RESOLUTION. While we cannot guarantee the work performed by a listed service professional or worker, and while we have no obligation to you with regard to your relationship with a service professional or Worker, ContactContractors will try and assist you in resolving any workmanship problems that may arise in the course of a home improvement repair or maintenance project and which may be the fault of a service professional you learned about through the ContactContractors services. Although we have no such obligation, we may, upon your request, provide limited assistance in resolving disputes between you and a service professional. You must participate and use good faith efforts to resolve problems through the ContactContractors resolution process. If, in its sole discretion, ContactContractors determines that you have not participated and cooperated in good faith in the resolution process, ContactContractors may terminate such Resolution Process. Any assistance in no way nullifies the release and indemnification described in these Terms & Conditions.
YOUR INFORMATION. ContactContractors is committed to protecting your privacy. Homeowner, Contractor, and Worker data collected is for the purpose of matching you with the appropriate Service Professionals or Homeowner. We will not sell, trade or rent your personal information to a third party without your permission. We may send you offers through email or otherwise, which we deem relevant to your specific trade(s). In the course of your ContactContractors membership, you expressly consent to being contacted by us in order to provide the services set forth on our site, to service your account, to address matters pertaining to your account, or for other purposes related to our business. Companies will maintain the privacy of all customer contact information.
Upon using the ContactContractors services, you will be prompted to disclose certain information about yourself and your service requirements, and you will be able to store information, such as home services records, on our website. Some of this information will be sent to Service Professionals or Workers who will need this information to respond to you or to other persons or entities in connection with our business. By providing this information to us, or by submitting a Service Request or Job Posting, you are requesting, and you expressly consent to being contacted by us and by our Service Professionals and providers via phone, fax, email, mail or other reasonable means, at any of your contact numbers or addresses, even if you are listed on any federal, state, provincial or other applicable "Do Not Call" list, in order that we may provide the services set forth on our site, to service your account, to reasonably address matters pertaining to your account or for other purposes reasonably related to your service request and our business, including marketing related emails.
You agree that by completing a Service Request or Job Posting, you are entering into a business relationship with ContactContractors and its partners and thus agree to be contacted by ContactContractors and/or its partners. You promise that all information you provide will be accurate, current and truthful to the best of your knowledge. If you provide any information that is untrue, not current or incomplete, ContactContractors has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, ContactContractors has the right to refuse any current or future use of the ContactContractors services (or any portion thereof) by you. You are responsible for any use of ContactContractor services by persons to whom you intentionally or negligently allow access to your password. ContactContractors has set up an email notification system for your service requests and job postings. If you choose to keep your information private, all service professionals and workers will only be able to contact you through our email system until you feel comfortable in releasing your contact information to the service professional or worker.
USING CONTACTCONTRACTORS.COM. You acknowledge and agree that your use of the ContactContractors services is for your personal use and not for any commercial or advertising purposes. You agree that all of the content and information posted on the ContactContractors Web site, including but not limited to Service Professional profiles, Worker Profiles, and Ratings & Reviews (including any ratings and reviews or other content posted by you), is the sole and exclusive property of ContactContractors, and that you have no right to reproduce, post, publish, or otherwise use such information other than for your personal use relating to your service request. You acknowledge that a violation of the foregoing could result in significant damages, and you agree that you are liable to ContactContractors for any such damages, and will indemnify ContactContractors in the event of any third party claims against ContactContractors based on or arising from your violation of the foregoing. We reserve the right to revoke your access to the ContactContractors website and services at any time.
All information about Service Professionals is confidential and for your personal use only. If it is determined or suspected by ContactContractors in its sole discretion that you are misusing or attempting to misuse or circumvent the ContactContractors services or system, or are using or attempting to use them for any inappropriate, non-personal, or commercial purposes, including but not limited to activities such as hacking, infiltrating, fraud, advertising, jamming or spamming, ContactContractors reserves the right, in its sole discretion, to immediately terminate your access without notice and to initiate without notice appropriate legal actions or proceedings to seek appropriate remedies and/or damages, including but not limited to lost revenue, repairs, legal fees, costs and expenses, and to seek injunctions or other equitable remedies.
TO KNOWINGLY INPUT FALSE INFORMATION, INCLUDING BUT NOT LIMITED TO NAME, PHONE NUMBER, ADDRESS OR E-MAIL ADDRESS IS A VERY SERIOUS AND FRAUDULENT MATTER THAT COULD RESULT IN SIGNIFICANT COSTS AND DAMAGES INCLUDING INVASION OF PRIVACY RIGHTS, TO CONTACTCONTRACTORS AND ITS SERVICE PROFESSIONAL PARTNERS, AND TO CONSUMERS, AS WELL AS THE LOSS OF TIME, EFFORT AND EXPENSE RESPONDING TO AND PURSUING SUCH FALSE INFORMATION AND REQUEST, AND FURTHER, COULD RESULT IN REGULATORY FINES AND PENALTIES. ACCORDINGLY, IF YOU KNOWINGLY INPUT FALSE INFORMATION IN A SERVICE REQUEST OR JOB POSTING, INCLUDING BUT NOT LIMITED TO SOME ONE ELSE'S NAME, E-MAIL ADDRESS, PHYSICAL ADDRESS OR PHONE NUMBER OR A RANDOM OR MADE UP NAME, ADDRESS, E-MAIL OR PHONE NUMBER YOU AGREE TO FULLY INDEMNIFY AND BE LIABLE TO CONTACTCONTRACTORS AND EACH CONTACTCONTRACTORS SERVICE PROVIDER OR WORKER WHO ACCEPTS SUCH SERVICE REQUESTS, FOR THE GREATER OF: (1) A MINIMUM AMOUNT OF $10,000 TO EACH OF CONTACTCONTRACTORS AND EACH OF THE AFFECTED SERVICE PROFESSIONALS AND FOR EACH OF THE ACTUAL PERSON(S) AFFECTED BY ANY OF THE IMPROPER, INCORRECT OR FRAUDULENT INFORMATION YOU ENTER (FOR EXAMPLE THE ACTUAL OWNER OF THE E-MAIL ADDRESS OR PHONE NUMBER, ETC.), PER IMPROPER SUBMISSION, PLUS ANY ATTORNEYS FEES COSTS AND EXPENSE RELATING THERETO, IF APPLICABLE, OR (2) THE ACTUAL DAMAGES, DIRECT, PUNITIVE AND CONSEQUENTIAL, AND ANY REGULATORY OR JUDICIAL FINES OR PENALTIES THAT MAY ARISE FROM SUCH INTENTIONAL, MISLEADING, HARMFUL AND FRAUDULENT ACTIVITY, PLUS REASONABLE LEGAL FEES, COST AND EXPENSES RELATING THERETO, WHICH EVER IS GREATER.
LINKED SITES. The links in the ContactContractors Web site will let you leave ContactContractors’ website. The linked sites are not under the control of ContactContractors and ContactContractors is not responsible for the contents or functionality of any linked site or any link contained in a linked site, or any changes or updates to such sites. ContactContractors is not responsible for webcasting or any other form of transmission received from any linked site. ContactContractors is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by ContactContractors of the site.
REGISTRATION ENROLLMENT PROCESS. ContactContractors.com uses the following criteria as part of its registration enrollment process ("registration") for new service professionals applying for membership in our network:
Licensing - ContactContractors confirms at the time of a service professionals registration, that a prospective new ContactContractors member has all applicable required state-level or provincial-level trade licensing. Certain states may require state-level licensing for projects above specified dollar amounts. We recommend you confirm these licensing requirements with the business and the applicable state and local licensing authorities. In some states, licensing may be required by the county or local authority in which the work is being performed. We recommend you confirm these licensing requirements before proceeding with your project. Larger projects often require the use of sub-contractors for specific types of work (for example, a kitchen remodel may require an electrician or plumber). We recommend you verify that all the sub-contractors doing work on your project carry the appropriate licensing. We always recommend that you ask the business to provide you with a copy of their license.
Insurance/Bonding - Where relevant, ContactContractors confirms general liability insurance coverage or bonding information (for movers, either cargo valuation coverage or general liability insurance coverage) presented by member service professionals in their profiles at the time of their registration with ContactContractors. ContactContractors confirms such coverage via the service professional’s insurance agent. ContactContractors does not confirm general liability coverage for certain categories of service professionals where such coverage is deemed not relevant, including but not limited to: Inspectors; Appraisers; Architects; Engineers; Consultants; Home Maintenance Services; Designers; Pre-Manufactured Cabinet Makers; Organizers; Permit Services; Disability Planners; Alarm System Monitors; Toxic Materials; Toxic Material Testing.
State Business Filings - For business types that require a Secretary of State filing, we confirm that the service professional is in good standing in the state in which it is located. This check applies to service professionals that are corporations and Limited Liability Companies (LLC’s).
Sex Offender Search - In the state in which the owner/principal of the company is located, we check the state’s official Sex Offender web site, to confirm that there is not a match based solely on the name of the owner/principal of the company. We do not run sex offender searches in any other states. Please note that only a fingerprint match can guarantee an accurate match for a sex offender search. We recommend that you check the applicable state sex offender website for any individual that will be performing work in your home.
Identity Verification (Reverse Phone Lookup) - We conduct a reverse business phone lookup to confirm that the phone number provided matches the phone listing for the business or principal.
Search for Business Aliases – ContactContractors searches state Doing Business As (DBA) records in the state in which the service professional is located to identify any aliases under which the service professional is doing business. The presence of records for this search does not necessarily mean anything negative. It is not uncommon for a business owner to operate using a d/b/a or to have multiple businesses filed with d/b/a’s. As part of your diligence, we encourage you to have a complete picture of the business you choose to work with.
NOTE: Member service professional information confirmed at the time of enrollment as described above may change or expire over time; while ContactContractors attempts to maintain accurate and up-to-date information, and confirms changes when notified, we perform screening solely at the time the member applies for membership in the ContactContractors network, and therefore, we cannot guarantee that profile and screening information is accurate. Therefore, we recommend that before working with a service professional you verify that information presented in the service professional's profile is still current and/or acceptable to you.
The above procedures may change from time to time at the sole discretion of ContactContractors. ContactContractors believes that it uses commercially reasonable methods to check these matters but does not make any representations or warranties that members are appropriately licensed, free of significant state-level civil legal judgments, or carry appropriate general liability insurance or bonding at the time of registration, during the period they are members, or thereafter. As circumstances can change daily, ContactContractors advises consumers to check these matters for themselves especially at future dates. ContactContractors does not represent or warrant that the information received from state, provincial or other government agencies or from third party sources is accurate, error free, or that it is up to date or updated at the time that ContactContractors checks such information. Most agencies have periodic update cycles or schedules and this information is not updated on a real-time basis by such agencies and third party sources.
DISCLAIMER: CONTACTCONTRACTORS EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED RELATING TO THE PRESCREENING PROCESS, CRITERIA, PROCEDURES, OR INFORMATION OBTAINED OR PRESENTED IN THE PRESCREENING PROCESS OR DISCLOSURES INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE, OR THAT THE SCREENING OR VERIFICATION PROCEDURES OR STANDARDS ARE SUFFICIENT OR THAT THE INFORMATION RECEIVED IN THESE SCREENING OR VERIFICATION PROCEDURES IS ACCURATE, TIMELY OR ERROR FREE.
PROFILES, RATINGS, REVIEWS. ContactContractors allows Service Professionals and Workers to post profiles about themselves and their business on the ContactContractors Web site. ContactContractors does not review or verify the information or representations set forth in those profiles, except as expressly set forth above, as they are self-reported by the Service Professional and Worker. All Ratings & Reviews of a Service Professional or Worker displayed to you reflect the opinions of other consumers, and do not reflect or represent the opinions or representations of ContactContractors. Homeowners should be careful to only post accurate statements about their experience with their contractors or workers, as slander laws are designed to protect people/companies from testimonial misuse. ContactContractors disclaims any and all representations or warranties with regard to the Ratings & Reviews.
INDEMNIFICATION. YOU AGREE TO INDEMNIFY CONTACTCONTRACTORS, AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, CO-BRANDERS, AND OTHER PARTNERS AND HOLD THEM EACH HARMLESS FROM ANY AND ALL CLAIMS OR DEMANDS, INCLUDING ATTORNEY'S FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING FROM YOUR USE OF THE CONTACTCONTRACTORS SERVICES OR IN CONNECTION WITH THE CONTACTCONTRACTORS WEB SITE OR YOUR VIOLATION OF THESE TERMS AND CONDITIONS, OR ARISING FROM YOUR VIOLATION OF ANY RIGHTS OF A THIRD PARTY.
GENERAL PROVISIONS. You acknowledge and agree that the ContactContractors services are provided to you on an "AS IS" basis without any warranty whatsoever, and your sole and exclusive remedy, and ContactContractors’ sole obligation to you or any third party for any claim arising out of your use of the ContactContractors services or the ContactContractors Web site, is that you are free to discontinue your use of the ContactContractors services or the ContactContractors Web site at any time. EXCEPT AS EXPRESSLY SET FORTH HEREIN, CONTACTCONTRACTORS EXPRESSLY DISCLAIMS ANY IMPLIED WARRANTIES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND YOU AGREE THAT CONTACTCONTRACTORS SHALL HAVE NO LIABILITY FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL (INCLUDING LOST PROFIT), EXEMPLARY OR PUNITIVE DAMAGES (EVEN IF CONTACTCONTRACTORS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) ARISING OUT OF THIS AGREEMENT OR ANY CONSEQUENCES WHICH FLOW FROM IT. SOME STATES AND PROVINCES DO NOT ALLOW LIMITATIONS ON OR EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN SUCH STATES AND PROVINCES, THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. The Terms and Conditions will inure to the benefit of ContactContractors’ successors, assigns and licensees. If any provision of these Terms and Conditions shall be deemed unlawful, void or unenforceable, for any reason, by any court of competent jurisdiction that provision shall be modified in order to make it enforceable, while maintaining the spirit of the provision. Alternatively, if modification is not possible, such provision shall be stricken and shall not affect the validity and enforceability of the remaining terms. The failure of ContactContractors to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the ContactContractors services or the Terms and Conditions must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the Terms and Conditions are for convenience only and have no legal or contractual effect. These Terms and Conditions are governed by the laws of the State of New York as such laws are applied to agreements entered into and to be performed entirely in the State of New York and between New York residents. You agree to submit to jurisdiction in New York and that any claim arising under these Terms and Conditions will be brought solely in a court in New York County, New York.
